12-10-01. Park Operating Policy and Hours.
- Park Hours. Parks shall be open to the public every day of the year. The opening and closing hours shall be posted in each Park for public information. Millennium Park hours will be 8:00 am to 12:00 am year round. Lincoln and Weigel Park hours will be 8:00 am to 10:00 pm April 1st thru October 31st and 8:00 am to 7:00 pm November 1st thru March 31st.
- Special Events. Permission to use the Parks for special events may be obtained from the Park Board, which will specify the extended hours the Parks will be available for such events.
- Closed Areas. Any section or part of any park may be declared closed to the public by the Park Board, Lincoln Police Department, or other proper authority at any time and for any interval of time, either temporarily, or at regular or stated intervals, daily or otherwise, and either entirely or merely to certain uses as shall be determined reasonably necessary. This will be posted in the respective Park if for a period of greater than 24 hours.
12-10-02. Restriction on Bringing Horses into Parks. It shall be unlawful for any person to ride a horse, or cause a horse to be brought into any Park unless an area in the Park is designated for horseback riding and related uses as evidenced by appropriate signs giving notice thereof.
12-10-03. Operation of Vehicles. For the purpose of this section the term “vehicle” shall include all motorized vehicles. It shall be unlawful for any person to do or commit any of the following acts in any of the Parks of the Park District:
- Ride, drive, operate, or park any vehicle upon any part of any Park, playground, or other public lands owned or controlled by the Park District, except on public roads and parkways therein or as otherwise designated by the Park Board.
- Ride, drive, or operate any vehicle in willful or wanton disregard of the rights or safety of others, without due caution or circumspection, or at a speed or in any manner which endangers, or is likely to endanger, any person or property.
12-10-04. Prohibited Acts Generally. It shall be unlawful for any person to do or commit any of the following acts in any of the Parks of the Park District:
- Throw stones or missiles.
- Carry or discharge any dangerous or concealed weapons, or any firearms, gun, air rifle, paintball gun, slingshot, or other similar weapon.
- Hunt, trap, or in any way catch, kill, or injure any animal or bird.
- Engage in fighting or assaulting one another.
- Disturb, tend to disturb, or aid in disturbing the peace of others or the use of any Park by others by violent, tumultuous, offensive, or obstreperous conduct or language.
- Carry, possess, ignite, or throw any fireworks or other explosive device on or into any Park.
- Ignite or maintain any fire for any purposes, except in such places as may be designated by the Park Board.
- Cut, pull, pluck, or otherwise injure any flowers, flowering plants, shrubs, or trees growing in any Park.
- Throw, place, deposit, or leave, or cause to be thrown, placed, deposited, or left, in any of the Parks, any waste paper, wood scraps, excelsior, straw, hay, leaves, brush, weeds, dry grass, shavings, rags, or other combustible materials, or any animal or vegetable refuse or offal, ashes or other refuse.
- Injure, deface, destroy, or remove real property or improvements thereto, or moveable or personal property belonging to the Park District.
- Tear down, remove, cut or otherwise injure or destroy any gate or fence enclosing any of the Parks.
- Damage or remove any sign or notice posted by order of the Park Board.
- Nail, paste up or otherwise post handbills, placards, or posters, or make, print or mark any word, character or advertisement of any kind upon any tree, plant, pole or post in any Park, or upon any vehicle therein, or scatter any handbills, placards or posters in such Park or upon any of the streets, ways or walks thereof.
- Enter upon any portion of a Park which is at that time temporarily or permanently closed to the public.
- Obstruct any roadway or path in any Park.
- Park or leave parked any motorized vehicle within any Park outside of stated park hours without having first obtained permission from the Park Board.
- Hitch any horse or other animal, except in such place as may be designated by the Park Board for such purpose.
- Permit any animal to run at large or fail to clean up after animal defecates.
- Camp overnight or enter, camp or remain within any Park outside of stated park hours without having obtained a permit from the Park Board.
- Appear in a state of nudity or in any indecent or lewd dress, or make any indecent exposure of his or her person, or engage in any lewd, indecent, immoral, or insulting conduct.
- Bring or carry into any Park any glass beverage container, or break or cause to be broken any glass object within any Park.
- Possess or consume any alcoholic beverage in any Park unless having first obtained a permit therefore pursuant to this code.
12-10-05. Activities for Which Permit Required. It shall be unlawful for any person to do any of the following acts within any of the Parks of the Park District without first receiving a permit to do so from the Park Board, or from some person authorized by such Board to grant a permit, and the granting of a permit shall be conditioned upon the agreement of the applicant therefore to observe all regulations and requirements which may be prescribed with reference to the subject matter thereof, and for violation of such regulations or requirements any such permit may be revoked by the Park Board:
- Maintain any refreshment stand or keep or offer any article of any character for sale.
- Possess or consume any alcoholic beverages.
- Post or display any sign, poster, flier, or banner.
- Render any musical program.
- Hold any public meeting or deliver any public address or participate in any parade or any other public demonstration.
- Enter, remain, or camp within any Park after stated park hours.
- Park any vehicle in any Park after stated park hours or in any restricted parking area.
- Use equipment of any kind or vehicles to amplify or project talking, singing, music, or noise of any kind.
- Solicit passengers for any vehicle for hire.
12-10-06. Abuse or Mutilation of Trees Prohibited. Unless specifically authorized in writing by the Park Board, no person shall intentionally damage, cut, carve, transplant, or remove any tree; attach any rope, wire, cable, nails, advertising posters, or such other contrivances to any tree; allow any gaseous liquid or solid substance which is harmful to trees to come in contact with them; or set fire to burn when such fire or heat thereof will injure any portion of any tree in any Park.
12-10-07. Protection of Trees Generally. All trees in any Park near any excavation or construction of any building, structure, or street, or utility work shall be guarded with a good substantial fence, frame, or box not less than four (4) feet high and eight (8) feet square, or at a distance in feet from the trunk of the tree equal to the diameter of the trunk in inches, whichever is greater; and all building material, soil, and other debris shall be kept outside of the barrier except where otherwise specified by the Park Board in writing.
12-10-08. Placing Materials on Park Property which Impede Passage of Air, Water, or Nutrients to Roots of Trees. No person shall deposit, place, store, or maintain upon any Park any stone, brick, sand, concrete, or other material which may impede free passage of air, water, or nutrients to the roots of any tree growing thereon except by written permit from the Park Board.
